Terms of Service

Pic+ provides websites, mobile applications, AI image and video generation tools, editing tools, asset libraries, templates, subscriptions, credits, and related products and services (collectively, the "Services").

We may modify, suspend, discontinue, limit, or replace any part of the Services at any time, including models, features, pricing, credit rules, generation limits, output formats, and availability.

• You must be at least 18 years old to use the Services.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate account, billing, and contact information and keep it up to date.
• We may refuse, suspend, or terminate access if we believe your account, content, payment, or use of the Services violates these Terms or applicable law.

"Input" means any content, files, images, videos, prompts, reference materials, instructions, settings, or other materials you upload, submit, or provide to the Services.

You retain any rights you have in your Input. You grant Pic+ and our service providers a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, modify, and use your Input solely as necessary to provide, secure, improve, troubleshoot, and enforce the Services and these Terms.

You represent that you have all rights, permissions, and legal authority needed to provide the Input and to allow us to process it.

"Output" means images, videos, edits, files, or other content generated or returned by the Services based on your Input.

As between you and Pic+, and to the extent permitted by applicable law, you may use Output for personal or commercial purposes, subject to these Terms, our policies, third-party rights, and applicable law.

• We do not guarantee that Output is unique, protectable by copyright, non-infringing, error-free, accurate, or suitable for any particular purpose.
• Similar or identical Output may be generated for other users.
• You are responsible for reviewing Output before using, publishing, selling, or distributing it.
• We do not use your uploaded Input or generated Output to train AI models.

Uploaded source images and videos are used to complete the generation or editing request. We do not retain uploaded source images or videos unless retention is necessary to provide the requested Services, maintain assets or history you choose to keep, troubleshoot errors, prevent abuse, comply with legal obligations, or enforce these Terms. When retention is no longer necessary, uploaded source files are deleted or de-identified. Generated outputs, task records, and related metadata may be saved to your assets, history, or account workspace when the feature supports it. Content saved to assets or history will generally be retained until you delete it, delete your account, or retention is no longer required to provide the Services, comply with law, resolve disputes, prevent fraud, or enforce these Terms.

• Paid features may require credits, a subscription, a membership, or another paid entitlement.
• Credits, prices, plan benefits, generation costs, limits, and availability may vary by feature, model, duration, resolution, region, platform, promotion, or account status.
• Credits are consumed when you submit or complete eligible generation requests according to the rules shown in the product.
• Used credits are non-refundable. Unused credits have no cash value and cannot be transferred, exchanged, resold, or redeemed for money unless required by law.
• Subscription fees are generally non-refundable once a billing period begins, except where required by law or expressly stated by Pic+.
• If you purchased through an app store or third-party payment platform, cancellations and refunds are handled by that platform under its rules.
• If you believe you were charged in error, experienced a duplicate charge, or a paid generation failed without credit restoration, contact us so we can review the issue.
• Cancelling a subscription stops future renewal but does not automatically refund prior charges or consumed credits.

You agree not to use the Services to create, upload, request, or distribute:

• Illegal, harmful, exploitative, abusive, hateful, harassing, defamatory, deceptive, or fraudulent content.
• Sexual content involving minors, non-consensual intimate content, or content that violates privacy or publicity rights.
• Content that infringes intellectual property, contractual rights, personal rights, or other third-party rights.
• Malware, spam, phishing, scams, security attacks, scraping, unauthorized automation, or attempts to bypass technical limits.
• Misleading content intended to impersonate others, deceive viewers, manipulate elections, or misrepresent real events without appropriate context.
• Content or activity that violates applicable laws, regulations, platform rules, payment rules, or our policies.

You are solely responsible for your Input, your use of Output, and any consequences of publishing, sharing, selling, or relying on Output.

We and our licensors own the Services, including software, interfaces, designs, systems, model integrations, templates, trademarks, logos, and related intellectual property. Except for the limited right to use the Services under these Terms, no rights are transferred to you.

You may not copy, reverse engineer, resell, sublicense, interfere with, or create competing services based on the Services, except where applicable law expressly allows it.

The Services and Output are provided "as is" and "as available." To the maximum extent permitted by law, Pic+ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

AI systems may produce unexpected, inaccurate, offensive, low-quality, incomplete, or similar outputs. We do not guarantee uninterrupted access, specific generation results, delivery times, or compatibility with every device, browser, platform, or workflow.

To the maximum extent permitted by law, Pic+ and its affiliates, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or content.

To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid to Pic+ for the Services giving rise to the claim during the three months before the claim or USD $100.

We may suspend, limit, or terminate your access to the Services, remove or restrict content, disable generation, revoke credits granted through abuse or error, or refuse future service if we believe you violated these Terms, our policies, payment rules, or applicable law, or if your use creates risk for Pic+, users, third parties, or the Services.

You may stop using the Services at any time. Some provisions, including ownership, payment obligations, disclaimers, limitations of liability, dispute terms, and provisions that by nature should survive, will survive termination.

We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date. If changes are material, we may provide additional notice through the Services or by other reasonable means. Your continued use of the Services after an update means you accept the updated Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. To the extent permitted by law, you and Pic+ agree that disputes relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and each party consents to personal jurisdiction and venue there.
